Thank you for purchasing a Doc Johnson product. To activate your 90 day product warranty simply fill in the 90 DAY WARRANTY REPLACEMENT REGISTRATION form. Please keep your original purchase receipt as evidence that the date of your claim falls within the 90 day warranty period.

DOC JOHNSON 90 DAY CLAIM PROCESS
In the unlikely instance that your Doc Johnson product is defective, please return your clean product in its original packaging along with your original receipt to the shipping address below. Please complete the verification form and include it in your shipment, along with a $15.00 check or U.S. money order made payable to the Doc Johnson Warranty Dept. to cover shipping and handling. You must be 18 years of age or older to submit your warranty claim.

COMMON QUESTIONS:

What do I do if my product fails to operate?

Do not leave batteries in the product between uses. If the electronic product fails to operate, check all batteries, their position in the battery compartment, and the metal spring clips which hold the batteries in place.

How long will it take to get a replacement product?

It usually takes 4-6 weeks or less from the time you ship the defective item to Doc Johnson and Doc Johnson inspects the product for replacement approval.

Can I get a product refund from Doc Johnson?

No. Doc Johnson does not refund the price of products that were purchased from a retail store. Please check the retail store’s return policy for refunds. Doc Johnson only replaces defective products.

For how long is my warranty good?

The 90 day limited warranty is good from the time you purchased your product from a retailer and proof of receipt to activate your warranty online.

How do I know the status of my product exchange?

Doc Johnson will notify you if there are any issues with your product when we receive it. You can contact us if you would like to ask us any questions.

Can I extend my warranty?

Currently Doc Johnson only allows a 90 day product warranty.

How do I file a claim?

90-Day Claim: Complete the verification form and fill out the 90-day warranty form online. Mail in your product with the age verification form, copy of your retail receipt and a $15.00 check/money order payable to “Doc Johnson Warranty Dept.”

What’s Covered – Health Devices Corporation d/b/a Doc Johnson (“Doc Johnson”), a Delaware corporation, warrants all Doc Johnson-branded products contained in the original packaging (“Doc Johnson Product”) against defects in materials and workmanship when used normally in accordance with Doc Johnson’s guidelines for a period of ninety (90) days from the date of original retail purchase by the end-user purchaser (“Warranty Period). Doc Johnson’s product guidelines include but are not limited to use, care, and maintenance instructions contained on product packaging and www.docjohnson.com. The warranty covers working parts that affect the function of the pleasure product.

What’s Not Covered – This Warranty does not apply to any non-Doc Johnson branded products, even if packaged or sold with a Doc Johnson Product. Manufacturers other than Doc Johnson may provide their own warranties to you – please contact them for further information. Doc Johnson is not responsible for damage arising from failure to follow instructions relating to the Doc Johnson Product’s use. This Warranty does not apply to: (a) consumable parts, such as batteries, lotions and lubricants; (b) cosmetic damage or deterioration, including but not limited to discoloration and broken plastic on ports; (c) loss of or damage to removable parts; (d) damage caused by use with another product; (e) damage caused by accident, abuse, misuse, liquid contact, fire, earthquake, or other external cause; (f) damage caused by use of the Doc Johnson Product outside Doc Johnson’s published guidelines; (g) damage caused by service performed by anyone who is not a representative of Doc Johnson; (h) a Doc Johnson Product that has been modified to alter functionality or capability; (i) defects caused by normal wear and tear or otherwise due to the normal aging of the Doc Johnson Product.

The defective Doc Johnson Product will be replaced with a new, identical Doc Johnson Product or, if unavailable, a new Doc Johnson Product of comparable value. Due to continuing improvements, replacement product may differ from the product submitted for a warranty claim.

LIMITATION OF REMEDIES: LIMITATION OF REMEDIES:

The foregoing is the sole warranty for Doc Johnson products. EXCEPT AS OTHERWISE PROVIDED BY LAW, Doc Johnson hereby disclaims any implied warranty that the products will be merchantable or fit for any particular purpose. Doc Johnson’s liability and customer’s exclusive remedy under the foregoing warranty will be limited to replacement of the product by Doc Johnson. The warranties above are exclusive and in lieu of all other warranties, whether express or implied, including warranties of merchantability and fitness for a particular purpose.

In no event will Doc Johnson be responsible for any special, incidental, or consequential damages resulting from the use of the Doc Johnson Product, or based on any breach of warranty, breach of contract, negligence, tort, or any other legal theory. Such excluded damages may include without limitation, loss of saving or revenue; loss of profit; loss of use; the claims of third parties, including without limitation retailers; any cost of any substitute equipment or services. In no event shall any liability of Doc Johnson exceed the purchase price of the Doc Johnson Product.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. The Warranty gives specific legal rights, and you may have other legal rights which vary from state to state.

DISPUTES/MANDATORY ARBITRATION:

PLEASE READ THIS PROVISION CAREFULLY. IT INCLUDES AN AGREEMENT TO MANDATORY ARBITRATION, WHICH MEANS THAT YOU AGREE TO SUBMIT ANY DISPUTE RELATED TO YOUR USE OF ANY DOC JOHNSON PRODUCT TO BINDING INDIVIDUAL ARBITRATION RATHER THAN PROCEED IN COURT. THIS PROVISION ALSO INCLUDES A CLASS ACTION WAIVER, WHICH MEANS THAT YOU AGREE TO PROCEED WITH ANY DISPUTE INDIVIDUALLY AND NOT AS PART OF A CLASS ACTION. THIS AGREEMENT ALSO INCLUDES A JURY WAIVER.

It is Doc Johnson’s goal that its products meet or exceed your expectations and that you are satisfied. In the event that you have a problem or dispute relating to the Warranty that needs special attention, you agree that you will give Doc Johnson the opportunity to resolve your problem or dispute by sending a written description of your problem or dispute to Doc Johnson Enterprises, Attn: Warranty Dept., P.O. Box 9908, North Hollywood, CA 91609-9908. You then agree to negotiate with Doc Johnson in good faith about your problem or dispute. This should lead to resolution, but if for some reason your problem or dispute is not resolved satisfactorily within sixty (60) days of Doc Johnson’s receipt of your written description of it, you agree to the further dispute resolution provisions below.

All disputes between the parties arising out of or relating to this Warranty, including the interpretation or enforcement of the terms herein, shall be settled by final and binding arbitration in Los Angeles County, California before a single arbitrator pursuant to the prevailing Rules of the American Arbitration Association. The arbitrator may award any legal or equitable remedy, and trial by jury is hereby expressly waived. Judgment may be entered on the arbitrator's award in any court of competent jurisdiction. You agree to pay your own fees, costs, and expenses, including those for any attorneys, experts, and witnesses.

Any such dispute shall not be combined or consolidated with a dispute involving any other person's or entity's product or claim, and specifically, without limitation of the foregoing, shall not under any circumstances proceed as part of a class action. The arbitration shall be conducted before a single arbitrator, whose award may not exceed, in form or amount, the relief allowed by the applicable law. The arbitration shall be conducted according to the American Arbitration Association (AAA) Commercial Arbitration Rules applicable to consumer disputes. This arbitration provision is entered pursuant to the Federal Arbitration Act. The laws of the State of California, without reference to its choice of laws principles, shall govern the interpretation of the Warranty and all disputes that are subject to this arbitration provision. The arbitrator shall decide all issues of interpretation and application of this arbitration provision and the Warranty.

This arbitration provision also applies to claims against Doc Johnson’s employees, representatives and affiliates if any such claim arises from the Doc Johnson Product's sale, condition or performance.
